These Terms and Conditions including the terms, policies and guidelines referred to herein constitute a binding agreement between Plenderleiths (“we”, “our” and “us”) and you (“customer”, “your”, and “you”). These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
These Terms and Conditions, together with our website prices, delivery details, contact details and Privacy Policy set out the whole of our agreement relating to the supply of the products by us.
We reserve the right to change, update or replace any part of the Terms and Conditions at any time. Your continued use of this website (or any part thereof) following such change shall constitute your acceptance of such change. It is your responsibility to check our website to determine whether the Terms and Conditions have been changed. If you do not agree to any change to the Terms and Conditions, then you must immediately stop using our website.

REGISTRATION
To make purchases on our website you will need to register. When you register with www.plenderleiths.co.uk you are required to provide information about yourself that is current, true, accurate and complete. You must provide your real name, telephone number, e-mail address and other information as requested. You will need to provide payment details to a third-party site that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided.
By using this site, you represent that you are at least the age of majority in your county or state of residence, or that you are the age of majority in your county or state of residence, and you have given us your consent to allow any of your minor dependents to use this site.
Should any of your information change before delivery of your order, please notify Plenderleiths by emailing: orders@plenderleths.co.uk and please mark as URGENT in the subject line of your email. Plenderleiths also has the right to change registration requirements at any time. If you provide an account password it should be unique and kept secure, and you must notify Plenderleiths immediately in the event of any security breach. Please refer to our Privacy Policy for information on how your data is used by Plenderleiths.
JEWELLERY
Our jewellery is hand-made and hallmarked at the London Assay Office. We make every effort to ensure that our jewellery is displayed as accurately as possible on our website. We give detailed descriptions of each piece of jewellery. We cannot illustrate our jewellery pieces at their actual size, and how you see the pieces depends on the size and type of your screen on which you view our website. There may be slight differences in appearance because of digital photographic reproduction or your screen settings. It is also difficult for us to guarantee a true representation of any colours.
ORDERS AND PAYMENT
Once you place your order and payment is made, we will email you by return that we acknowledge your order.
As all our jewellery is made to order we will review our workshop schedule and within 5 working days of receiving your order you will receive an Order Confirmation email from Plenderleiths (orders@plenderleiths.co.uk) with an estimated delivery date. The Order Confirmation brings into existence a legally binding contract between you and Plenderleiths. Completion of the contract between you and Plenderleiths will be achieved when you receive a final email to confirm that your order has been dispatched. A tracking number will be provided to you at that time.
Payment must be arranged for using any method as specified on our website. We accept Visa, MasterCard, PayPal, Apple Pay and Google Pay.
You have the right to cancel your order within 24 hours of our acknowledgement of your order. This must be sent by email to order@plenderleiths.co.uk and marked URGENT in the subject line.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
PRICES
The price of each product will be as stated on our website www.plenderleiths.co.uk at the time your order is submitted. Prices shown on our website are in British Pounds Sterling (GBP).
Our prices may change at any time due to the fluctuations and volatility in precious metals market or material costs which are beyond our control should we discover that our suppliers prices have changed or that there has been a pricing error when we received your order, we will contact you and ask if you wish to proceed with your order at the correct price. If you confirm that you do wish to proceed, we will process your order and send you an email confirming your order.
Our jewellery pricing does not include the cost of delivery and insurance.
OUR RIGHT TO CANCEL
We reserve the right at our sole discretion to cancel the contract between you and us. This may be, for instance, because one or more of the items you ordered was listed at an incorrect price due to an omission, inaccuracies, a typographical error or if there is a sudden increase in our costs.
If we do cancel your contract, we will notify you by email or by telephone and will re-credit to your account any sum deducted by us from your credit card as soon as possible and within 28 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
DELIVERY
Your order will be dispatched to the address provided by you to us for delivery at the time you place your order or any updated address if received by us in sufficient time. It is your responsibility to ensure that the delivery address you give us is fully correct and that there is somebody to sign for and take delivery of the goods on arrival at your address. You will become the owner of the goods you have ordered when they have been dispatched to you. Once your order has been delivered to you it will be held at your own risk, and we will not be liable for its loss or destruction. If your order is returned to us because the courier or postal service could not complete the delivery to you for whatever reason, then you will be responsible for your order until it is received by us as well as any re-delivery charges.
We dispatch most of our packages by Royal Mail Special Delivery @ £9.50 per delivery address within the UK. This cost includes insurance up to a value of £750. This is a next day delivery service and must be signed for on receipt. Next day delivery is not available on Friday, Saturday, Sunday or Bank Holidays and your order will take longer to reach you. The delivery cost may be increased for orders which contain items of a large number or value.
A personal hand delivery service may also be available for £25.00 per delivery address within London Zones 1-4 only.
RETURNS POLICY
The policy is governed by the Consumer Rights Act 2015.
If you are not completely satisfied with your purchase, we’re sorry to hear that. All of our jewellery is made to order and usually made to measure and is generally not returnable. A full refund is offered if your jewellery is faulty, not as described on the website, or does not do what is designed to do.
We have endevoured, using the information you have supplied to us, to make you a piece of jewellery which fits and you will treasure. If an item is to be returned to us for the reasons above it must be un-worn in the condition in which they were sent to you and returned in their original packaging including the original receipt and sent from the person who purchased the item. We will issue a full refund on receipt of the jewellery and following a thorough check of the item(s). Please allow 14 working days for Plenderleiths to process a refund. We cannot accept responsibility for the time it takes your bank, credit card company or Pay Pal to process the refund.
Alternatively, if preferred, we will also be happy to exchange the item.
Jewellery will only be accepted for return if you notify us by email returns@plenderleiths.co.uk within 14 days of delivery with an explanation of the problem with the item and the item is returned to us and received by us within 28 days of the original delivery to you.
The jewellery is your responsibility until it reaches us. For your own protection we recommend that you send the parcel using a delivery service that insures you for the value of the goods.
The cost of returning the order to us is your responsibility. Delivery charges are only refundable where the jewellery is faulty.
OUR GUARANTEE POLICY
Plenderleiths jewellery is made to last a lifetime and guaranteed for 12 months, under normal conditions of wear and tear (see Jewellery Care).
GOLD PLATING
We cannot guarantee the plating on gold jewellery, as its wear and tear depends on the type of piece it is and how it is worn. For instance, gold plating may eventually wear off more on a bracelet than on earrings.
Gold plating is 4 Microns of hard plating 18 carat yellow or red gold on hallmarked silver. We will try to achieve a consistent colour of gold plating; however, gold plating is a complex process and there can be a minor variation of shade.
GOLD RE-PLATING
Plenderleiths gold plating may eventually wear-off your jewellery, especially on bracelets. We are happy to re-plate your Plenderleith gold plated items. This will take 3-4 weeks.

REPAIRS
Plenderleiths jewellery is guaranteed for 12 months, under normal conditions of wear and tear (see Jewellery Care).
If, before 12 months your jewellery is faulty, please contact us to discuss.
After 12 months, if your Plenderleiths jewellery needs to be repaired, please contact us on queries@plenderleiths.co.uk to discuss the repair and any charges.
JEWELLERY CARE
Our jewellery is hand crafted, finely finished and strong. It is made to be worn. Natural oxidation causes silver surfaces to tarnish which will make them look dull. Gold jewellery doesn’t tarnish but gold-plated silver jewellery does.
There are steps you can take to keep your jewellery looking its best.
Keep your jewellery in the original boxes or wrap it in acid free tissue.
Avoid contamination from other metals – do not keep your jewellery in your jewellery box with other jewellery.
Rinse in warm soapy water and dry with a soft cloth.
Please contact us if you want your silver jewellery to be re-oxidised (blackened silver) or re-gold plated.

COMPLAINTS
If you have a complaint please email us at complaints@plenderleiths.co.uk giving us details of your complaint including; the date of your purchase, an order reference number and your name, address and contact details.
LIABILITY
Nothing in these Terms will limit Plenderleiths liability for death or personal injury resulting from our negligence or that of our employees or agents. If you are a consumer (within the meaning of the Unfair Contract Terms Act 1977) the content of these Terms will not affect your statutory rights. If Plenderleiths is unable to or fails to deliver the products ordered within any time specified, we will use reasonable endeavours to contact you in order to re-schedule a delivery date. Plenderleiths does not warrant or guarantee the delivery date specified in the Order Confirmation and shall have no liability to you for any loss, damage, costs, expenses or other claims that you may incur because of late delivery. Plenderleiths will not be in breach of contract because of any Force Majeure event. In any event, the liability of Plenderleiths for any breach or the aggregate liability for any series of breaches under or in connection with these Terms shall not exceed the value of the relevant order/s placed by you from time to time.
Plenderleiths will hold no liability for loss of profit or for any indirect, special or consequential loss of damage, costs, expenses or other claims for compensation whatsoever arising out of or in connection with the supply or non-supply of the purchased jewellery (including any delay in supplying the jewellery) or their use or resale by you. Other than as set out in our Returns Policy, the entire liability of Plenderleiths arising out of any order for jewellery from you will be limited to the total price of the jewellery ordered by you. You must observe and comply with all applicable regulations and legislation, including all necessary customs, import or other permits to purchase items from www.plenderleiths.co.uk. The importation or exportation of Plenderleiths jewellery may be prohibited by certain national laws. Plenderleiths makes no representation and accepts no liability in respect of the import or export of the jewellery you purchase from us.
INDEMNIFICATION
You agree to indemnify, defend and hold harmless Plenderleiths and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
PRIVACY POLICY
Plenderleiths is committed to protecting the privacy of our website visitors and our customers. We will not disclose information about our customers to third parties except where it is part of fulfilling your order or providing a service to you.
Your consent is important to us; therefore we will never sell your name, address, e-mail address or any other personal information to any third party without your consent. Any personal data gathered by us in your use of this site will be recorded electronically and comply with the UK Data Protection Act 1998.
Communication & Marketing
We use your email address to contact you about your order or any reminder service. From time to time, we may occasionally update you on Plenderleiths news. We will not pass on your details on to any other third parties. We do not store credit or bank card details, nor do we share your customer details with any third parties.

We may give notice to you at either the email you provide to us or by post at the address you provided to us when placing an order on our website. Notice will be deemed received and properly served three days after an email is sent, or after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email that such email was sent to the specified email address of the addressee.
WAIVER
Failure or delay by us in enforcing or partially enforcing any provision of the Contract shall not be construed as a waiver of any of our rights under the Contract. Any waiver by us of any breach of, or any default under, any provision of the Contract shall not be construed as a waiver of any subsequent breach or default and shall in no way affect the other terms of the Contract.
GOVERNING LAW
Your use of this site and any contract between you and Plenderleiths for the sale of jewellery and/or services shall be governed by and shall be construed in accordance with the laws of the United Kingdom and shall be subject to the non-exclusive jurisdiction of the United Kingdom. If any provision of these Terms and Conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity or enforceability of any remaining provisions. If we fail to enforce a right under these Terms and Conditions, that failure will not prevent us from enforcing other rights, or the same type of right on a later occasion.
INTELLECTUAL PROPERTY (“IP”)
All materials, including images, illustrations, designs, photographs, site layout, written and other text or script that are part of this site together with all software compilations, underlying source code and software in the site are protected by copyright, design right, and/or other worldwide IP rights and are owned or controlled by Plenderleiths.
The entire content of our website, including all copyright, trademarks and other IP rights it contains, including the use of the name Plenderleiths, is the sole property of Plenderleiths. You are permitted to use such materials only for the purpose of ordering jewellery from our website, but you are not entitled to commercially exploit such material. All IP rights in the Products (subject to the rights of any third party) belong to Plenderleiths. You warrant that all customer material provided to us will not infringe the copyright or other rights of any third party, and you shall compensate Plenderleiths against any loss, damages, costs, expenses or other claims arising out of any such infringement.
THIRD PARTY PROVIDERS
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
